I’ve heard it’s happened, it’s caused by a weak spot in the metal or a bullet that has been loaded too many times. Never happened to me. As for me, there was nothing off about the feel or sound. But my sighter/scorer saw the trace.

Here you can’t cut a tree bigger than 19” wide iirc. Even if dead you’re supposed to call to have it checked. Does your area have a bylaw like that? Nice to get him fined while you see if you’ve suffered any emotional damage. 🤣

Not sure I want them up there either, snoopy white shirt, goody two shoes bylaw enforcers. Might be friendly with the guy than I. He's a well known hustler, houses, boats, cars, backhoes, dump trucks,lots of things going on. Busy old fk, busted a garbage box I made snow plowing 1 year and not a word. Hes been on the wrong side of the law a number of times and walks, something funny about the family, Car dealers, one brother is / was a disgraced lawyer....has money and with his businesses a lot would be cash.

No we have no such law out in the country. lots of trees. He said he thought he was doing me a favor, a big wind coulda knocked it onto my house. Look he says you see that one leaning as he pointed to another big tree. No I like my trees. You cut yours if you want!

He chopped down dozens to maker his back yard open then shoved in dirt to level it off. Then wanted more so he did it again and chopped my trees in the process

Pretty much you have to get out there and stop him. Video him with your phone. Tell him you’re calling the cops to get him charged with trespassing.

If you have access to a WiFi trail cam or a camera you can put in a window that helps. Depends on the asshole.

Hardest part is not dealing with it yourself. At least in the country you can get away with the three S’s. 🤣

I emailed the local lawyer, with no reply as yet. I might break down and call him. Their web page says a fast reply 24-48hrs...times up mfkrs. Its criminal trespass, I've been googling provincial laws Tort law???? but I read a case that set a precedent I guess. It is criminal, like destroying a farmers field with a truck without expressed permission to be there.

The most he’s allowed to do is cut a branch that goes over the property line. Even then it is supposed to be properly as to protect the tree.

That's some shit about them trees... I'm a tree hugger myself since a kid. I don't trust people that clear their entire yard of trees....

Morning all.

Suns out but it rained earlier. Off/on rain until Monday. Warm enough though so I’ll take it.

Wife had to go to hospital around midnight. She’s been sick all week and took the last few days off work. She’s home again but back in bed. Normally I don’t worry but were older now and these things can get serious fast.

Down side of working at a hospital is you never know what you’re going to catch.

Gardens starting to set and growing. Plants are nearing harvest. City is finally agreeing to return our money. Roof hasn’t leaked since we patched the suspected spot.

Only down side is the electric bill jumped now that my sons 3D printer is working again. 🤣

I can live with that. 😎

One thing I'll say for the city, everybody has fences! mainly to keep the thieves out, but it also helps with issues like this

Out in the country like that it's impossible to fence, or darn near it.

Shouldn't have to fence in the country anyway, unless you're trying to contain livestock, that's a shitty thing your neighbor did

Pipe my neighbor sold me this place and then ignored the property line and harvested some of the best off the west side of my property. White Oak and Walnut. This ended up in court and he paid dearly for the timber he stole. Yes, in Missouri theft of timber is a crime. The money in no way compensated for the hundreds of years that timber had grown, or his total disrespect of surveyed property lines and his thieving ass ways. But, it did stop the problem.
 
This weather is nuts! It’s the end of May and it’s 62*. That’s insane! I’m still hauling pellets for the heating downstairs. Still wearing hoodies just to sit on the front porch and running heat every night in the She Shed. Enough already!

I spoke to a secretary at teh lawyers office and she didn't sound to keen on me seeing a lawyer and suggested small claims court, I said okay can I have a consultation and gets some tips help on doing that, How do I asses damages? She said she'd see if one of the lawyers will look at it for me....how fking generous...isn't that what they do? too small for their firm. I'll have to look around but I've dealt with these guys in the past I thought they'd at least give me a call back after an inquiry with an explanation of what I'm looking for....

62f??? we'd be in Tshirts * shorts and call that summer.....lol....when it gets hot here its hot we've had 2 days over 60f this month.. I just mowed the grass for the first time today.
 
The problem with small claims court is even if you win good luck collecting. If this guy is a shady business man he will have nothing in his name. Years ago my brother installed two overhead garage doors at a clients home then after installed said i have no money. Took him to small claims court won the case but then find out everything in wifes name cant get blood from a stone. Asked judge if he can go remove doors judge told him you will charged with theft if you do ?????

I see what you are saying, but this was not a small claims court, it was a theft case. He was happy to write that check the day of court.
