The problem with small claims court is even if you win good luck collecting. If this guy is a shady business man he will have nothing in his name. Years ago my brother installed two overhead garage doors at a clients home then after installed said i have no money. Took him to small claims court won the case but then find out everything in wifes name cant get blood from a stone. Asked judge if he can go remove doors judge told him you will charged with theft if you do ?????
Yes I've been through that with our C/V store a women rented 10 kids movies on a deal we had and never returned them. I took her to Small claims court and won about $150 + court cost of $80...never saw a dime. It was just a waste of time and $80 trying to get the movies back

I used to have to sue non paying clients in small claims all the time so I got to be pretty good at it.

Yes, the sucky/risky part is the collections part. If you have the receipts then the case should be in your favor easily but even with a judgement in hand actually collecting is a whole other thing. Not sure what your state or county allows but when I was in LA county you could summon the Sheriffs department to stand in front of their business every day collecting the mail and removing any checks to the company you sued until the Sheriff had enough to satisfy the judgement. This cost me $150 a day but the Sheriffs would collect their pay along with the judgement amount so it was the defendant that had to pay the Sheriff to stand out there. I would usually get paid the same day the Sheriff stood his post. No one wants a Sheriff standing in front of their business for customers to see so, miraculously, they seemed to find the money to write the check. Best part was when they tried to be tricky and write a check to get the Sheriff to leave only to stop payment on the check. Sheriff doesn't take kindly to stop payment and NSF checks. Had one client get charged with fraud for trying to do that.

Unfortunately this is true.

Unless it’s a large company that cares about its public image, or a government body that you have proof you caught doing wrong, your pretty much relying on their integrity to follow through with the courts orders.

Getting them fined or charged has much more impact imo.

Sorry I’ve been MIA. My Hubby has been down for the past 3-4 weeks. Been busy doing my chores and his as well as running to the Dr. several times. He is set for surgery June the 18th. He has a collapsed disc that is sitting atop of and pinching the nerve roots to his lower back, hips and legs.
I been struggling. Due to the constant rain, the first of the year lawn maintenance weed eating limb trimming etc. was never completed. I’ve about got it all caught up, been years since I slung a weed eater.
By the time I get it all attended to my wagon be dragging. I’m now well aware of all the things he does around here!
I’m about to get it all caught up. By the time I shower at night and have a smoke, I’m out!

Got the Belmont Horse races and festival in town this week.
Free Gin Blossoms concert in town tomorrow night.
I mean right on Broadway in town~!

There are rumors Belmont track may not be completed on time and Saratoga could have it for a third year.
 
Granny, i sure hope your hubby has success for his surgery.. thoughts and prayers on that one for sure!!!!!!!

we've been hit really bad with the rains too, i had to mow twice in may and i'm a once a month kinda guy. maybe i can skip june to make up for it!! haha i doubt it. once it gets too high and the chickens have to run side legged o clear the tall grass it's time to mow!! haha and no weed wacking at all.. i use it to turn sideways and edge the sidewalk and thats the most my trimmer get used for. if the mower deck can't reach it then it don't get cut. its a rule here!!! hehe

we miss ya around ya here!!! later on in the summer if things settle down i'd like pick your brain on some glass art...

yesterday it was 66 here for a high... today, 85 right now! bunch of BS!!! if i happen to see the local weatherman in town this week i'm gonna kick him right in the jimmy's!!! hahaha

Thanks! I believe the Hubby will come out of this pretty quick, and I’m hanging in like a hair in a biscuit. Just wears my ole self out. Who knows by the time we get through this I may be running marathons lol.

Thanks Roots! He’s actually looking forward to the surgery. It’s three collapsed disc all sitting/cutting the nerve roots. Nothing seems to dull nor control the pain. It’s relentless.
As for me, I’m hanging in there. Am close to gettIng everything caught up. I’m even soaking seeds today!

Had a friend with really bad sciatica. She said the moment she came out of anesthesia the relief was instant. Yes the surgery itself was painful but nothing compared to what she was dealing with.

Hopefully the same happens for your husband.
 
What are you growing next Granny?
I need to flip my room to flower but have clones and seedlings to deal with also this time. ;hw
90f today so may finally be getting close to summer here?
Let ya know this evening when I have made up my mind. Right now it’s like being a kid with a Sears Christmas catalog being told I can pick six things..😁
